Asset Protection Kansas City
Protecting Your Possessions
is what we do best.
“Asset protection” in Kansas City is a general term to describe any steps taken to discourage or lawfully restrict others from your assets or possessions.
This may be used to deter nursing home costs, Medicaid or other government agency consideration, greedy family members or “friends,” creditors, or those who file lawsuits. It is best to consider this sooner, rather than later—well before anything happens to a loved one or when there may be an argument of a loved one's diminished capacity to do it.
Protecting your possessions may include various types of insurance, transferring assets to other people, but most commonly refers to trusts in the context of estate planning. Possessions held, titled or owned in the name of a properly drafted trust may be able to be used for a client, but not considered to be owned by the client in case of the nursing home, lawsuit, or “shifty nephew.”
How It Works
At the first appointment, you will talk with an attorney about asset protection in Kansas City. We will collect your information and discuss your goals in order to give you options for your particular case.
After 2 to 3 weeks, giving the attorney the opportunity to draft your proposed documents, you will again meet with the attorney to review and likely sign your estate planning documents.
After another 2-3 weeks, you’ll have what is likely your last face-to-face appointment to receive the original and copies of your documents and begin retitling your assets to your trust.
Unless a major even occurs in your life, requiring changes for your documents, the attorney will contact you in approximately three (3) years for a brief review to ensure your current estate plan remains relevant to any changes that may have occurred.

This commonly includes planning for the inevitable with Wills and Trusts or planning for the unforeseen with Powers of Attorney, Guardianships, and Medicaid or VA benefits.
Our caring staff listens to your situation and concerns, then calmly and expeditiously explain your options with a timeline for completion. Our goal is to provide each client with security in legally planning for the inevitable and unforeseen regarding their passing and long-term care needs.
Rusty has been a personal friend for many years but when he started handling our legal matters, we realized just what a God-send he is. He is knowledgeable, but always takes the time to find out about us before getting into business talk. By doing that, he is able to meet the needs we may not even know we have. In addition to his legal help, he has built a very capable team that has expertise in Elder Care as a whole. Highly recommend.

The service I most appreciated was the love and compassion we received during a very hard time in my life. Russell took charge and talked me through everything I needed to do to make it run smooth. I am very confident if we would not have had Russell do our mother’s trust before she passed away, we would still be dealing with it 4 years later. If you don’t use them, I promise you are missing out.
